Progress was made in September 2018 when the Virginia State Board of Pharmacy licensed five companies to operate medical marijuana dispensaries. However, as of the time of writing they are still yet to open for business.

In 2019, Democrats won control of both the house and the senate in Virginia. This cleared the way for the state to enact more serious medical cannabis laws. Cannabis oils containing up to 10 mg of THC per dose became legal for medical marijuana patients with the passage of SB 1557. Other types of products such as capsules and creams will also be made available. However, smokable cannabis products such as dried flower and hash are not permitted under these laws.

A decriminalization bill is expected to pass and be signed by the governor making Virginia the 27th state to decriminalize marijuana.

In March 2020, a bill was approved to completely legalize CBD and THC-A-rich medical cannabis products rather than just providing patients with an affirmative defense. That bill is now headed to the governor’s desk for approval.
